Cmytrip is not liable for any loss or damage to luggage during travel.We are not liable for any delay or change in your journey due to unavoidable circumstances, which might be anything.

We are not liable for any damage, loss, or injury sustained while enjoying the holiday packages we provide. You are responsible for your own safety measures.

We are also not accountable for any human error that gone unnoticed by the clients and our staffs.

Supplier:
We act as an intermediary for and sell various travel related products as agents on behalf of, numerous transport, accommodation,and other service providers, such as airlines, bus, activities, holidays and cruise line operators, as well as all of our wholesalers.

Any services we provide for you are considered collateral to the agency relationship. Our obligation to you is to make travel bookings on your behalf, and you expressly permit us to create applicable contracts between you and travel service providers. We carefully pick reputable service providers, but we are not a supplier of travel services and have no control over, or liability for, the services offered by third parties.

All bookings are made on your behalf and are subject to the service providers' terms and conditions, which include carriage requirements and liability limitations. Specifically, if for any reason (except negligence on our part) any travel service provider is unable to supply the services for which you have contracted, your rights are against that provider rather than against us.

1.Flight Tickets:
TERMS AND CONDITIONS OF THE AIRLINES:

The airline tickets available through the Website are subject to the terms & conditions of the concerned airline, As we are working as an intermediary between service provider and the User to book a flight ticket.

The contract of service for utilization of the flight is always between the User and the concerned airline. Airlines retain the right to reschedule flight times, route, change or cancel flights or itineraries independent of and without prior intimation to Cmytrip.

Cmytrip has no control or authority over the logistics of the airlines and therefore is not liable for any loss, direct or incidental, that a User may incur due to such change or cancellation of a flight.

Different tickets on the same airline may carry different restrictions or include different services and price.The baggage allowance on given fare is as per the terms decided by the airline, and Cmytip has no role to play in the same.

Some of the fares shown in the booking flow are “hand baggage fares” which do not entitle the User for free check in baggage and therefore the User will be required to pay separately for check in baggage. The prices for adding check-in baggage to a booking may vary from airline to airline. The User is advised to contact the airlines for detailed costs.

USE OF FLIGHT SEGMENTS:
In the event User does not embark on the onward journey, the entire PNR pertaining to that booking shall be automatically cancelled by the airline. In such a scenario Cmytrip has no control in the said process nor will be obligated to provide alternate bookings to the User. The cancellation penalty in such an event shall be as per the applicable airline rules.

CODE SHARE:
Some airlines enter into "code share" agreements with other Airlines. This means that on certain routes, the airline carrier selling or marketing the flight ticket does not fly its own aircraft to that destination. Instead, it contracts or partners with another airline to fly to that destination. The partner airline is listed as "operated by" in the booking flow.

Airline Pregnancy Rules:
All airlines recommend the pregnant ladies to consult a doctor before traveling at any point during their pregnancy. We request all pregnant ladies to read pregnancy rules of the respective airlines before planning their trip.

Some important points that need to be followed are:
Take a medical clearance from your healthcare provider or doctor not more than 7 days before your journey stating that you are fit to travel.

You should avoid taking flights if your pregnancy is complicated and risky in nature.

You should take your due date into consideration for return trip.If you are travelling on long-haul flights, identify if your body allows you to take a hectic flight journey as the seat-width may be uncomfortable in case of heavy pregnancy.For detailed information about the same, please contact the airline you are travelling with.

Special Request:
• Any special request for a meal, seat, wheelchair, bassinet, etc. need to request at least 72 hours prior to your flight departure. • Whenever you request any special service, please double check in your booking whether it’s updated or not else please call us immediately. Any complimentary service is not guaranteed as it is subject to availability. • If you are traveling with combination fares of two or more airlines, cmytrip is not responsible for any flight delays.Please also check the baggage allowance with airline directly.

PRICING:
The total price displayed on the Website on the payment page usually includes base fare, applicable government taxes and our convenience fee. Users are required to pay the entire amount prior to the confirmation of their booking(s). In the event the User does not pay the entire amount, cmytrip.com reserves the right to cancel the booking.

While Cmytrip offers the lowest fares, the same is subject to the availability of seats, selection of specific sector, timing of booking and terms and conditions of the airline/third-party service provider/ operator etc.

All flight travel costs are dynamic and subject to change. As a result, the suggested pricing on our website are only valid for same-day bookings that are made before the suggested fares expire (in the event that an airline changes its suggested fares without prior notification, Cmytrip will not be held liable).

TAX:
Any taxes or charges imposed by the government or airport authorities are payable by passengers. These are either included in the fare amount or to be paid upon arrival or departure in local currency at the airport of arrival or departure. In case of cancellation/refund many taxes are non-refundable.

Name Policy:
It is essential that you enter details of each traveler correctly and according to passport or other ID Proofs. Some suppliers will deny carriage if the traveler's name varies from your booking and may cancel automatically if the traveler's name is amended. Cmytrip is not responsible for any loss or damage arising from incorrect entry of traveler's name nor for any inability to travel as a result of carrier's policies.

If the passenger doesn’t have the last name (or) First name in passport, please reconfirm name format with airline before booking.

PASSPORT AND VISAS:
It is the responsibility of the individual traveler to check passport, visa and health requirements. All travellers departing India require a passport and it is recommended to have a minimum validity of 6 months. An Indian re-entry visa is required for those travellers traveling on a foreign passport. We are happy to provide assistance

Travel documents:
• Please make sure that you have all relevant travel documents like,. visa, transit visa (or)ok to board. • Passport must be valid for 6 months from date of departure (on return date also). • All travellers must carry hard copies of their foreign visa (soft copies won’t be accepted). • All visa rules on our website are just indicative and its updated with best of our efforts.• Cmytrip holds no liability for any claims about non-travel because of the lack of any travel document. • Travellers are solely responsible for ensuring their eligibility to enter the destination or transit countries. • User understands that the information (if any) provided by Cmytrip regarding the travel documents is only advisory in nature and can’t be considered conclusive

Booking Policy:
In case of increase in the fare in the issuance of the Air ticket , due to airlines miscalculation in amount due to server error and from the banks payment gateway issue then Cmytrip reserves the right to cancel the ticket and forfeit the amount received as Cancellation Charges.

To get any infant’s ticket issued; the age of infant must be below 2 yrs and make sure that they have valid proof-of-age documents when they’re checking in, and remember that the infant must be accompanied by an adult at least 18 years old. You can book no more than one infant per adult.

To avail infant fares; the infant must be under 24 months of age throughout the entire itinerary that you’re booking. If the age of infant is 24 months or above then you need to book a separate booking as a child.

To get any child ticket issued; the age of child must in between 2-12 years and make sure that they have valid proof-of-age documents when they re checking in, and remember that the child must be accompanied by an adult at least 18 years old.

All the tickets/bookings issued to the customer shall additionally be governed under the terms and conditions as laid out by the respective Airlines/Supplier.

If ticket is cancelled directly from the airlines web site , office or call centre , customer needs to inform Cmytrip for the refund to be processed. Please note that cmytrip do not get any alert from airlines directly.

The amenities, services, routes, schedule, aircraft type, seat availability and any other details pertaining to the flight service are provided by the respective airlines and CMT has no control over such information provided by the airlines.

CHECK-IN TERMS User should check with the airlines directly regarding the check-in timings.

Usually, check-in begins 2 hours before departure for domestic flights, and 3 hours before departure for international flights.

User should carry valid identification proofs, passport, age proofs as may be required to prove the identity, nationality and age of the passengers travelling on a ticket, including infants.

Before travelling to UAE (Dubai/Sharjah/Abu Dhabi), Kuwait, Bahrain, Muscat, Oman and Qatar, Indian citizens need more than just a visa. It is the ‘OK to Board’ – an airline requirement without which the passengers won’t be permitted to board the flight to the above mentioned destinations.

Standard Cancellation Policy:
You can cancel your booking as per the cancellation policy of the respective airline.Cancellation with in 24 Hours of Scheduled Departure Time must be cancelled with the Airline directly, Cmytrip will not be liable in any way if the passenger is No Show.

All Bookings cancelled may attract charges levied by airlines.

Refund Process time:
Minimum 1 working day to 10 working days depending upon the bank, airline and service provider.

Money credited to the Cmytrip wallet will not be credited back to individual/agents bank account.

2.HOTELS:
ROLE AND LIMITATION OF LIABILITY:
Cmytrip acts as a facilitator and merely provides an online platform to the User to select and book a particular hotel. Hotels in this context includes all categories of accommodations such as hotels, home-stays, bed and breakfast stays, farm-houses and any other alternate accommodations.

All the information pertaining to the hotel including the category of the hotel, images, room type, amenities and facilities available at the hotel are as per the information provided by the hotel/ suppliers (or) consolidator’s to Cmytrip.

This information is for reference only. Any discrepancy that may exist between the website pictures and actual settings of the hotel shall be raised by the User with the hotel directly, and shall be resolved between the User and hotel.

Cmytrip will have no responsibility in that process of resolution, and shall not take any liability for such discrepancies.

INFORMATION AND THE TERMS OF THE HOTEL:
The hotel booking voucher which Cmytrip issues to a User is solely based on the information provided or updated by the hotel/supplier/consolidator regarding the inventory availability.

In no circumstances can Cmytrip be held liable for failure on part of a hotel to accommodate the User with a confirmed booking, the standard of service or any insufficiency in the services, or any other service related issues at the hotel.

The liability of Cmytrip in case of denial of check-in by a hotel for any reason what-so-ever including over-booking, system or technical errors, or unavailability of rooms etc., will be limited to either providing a similar alternate accommodation at the discretion of Cmytrip (subject to availability at that time), or refunding the booking amount fully which we received from the User. Any other service related issues should be directly resolved by the User with the hotel.

Hotels reserves the sole right of admission and Cmytrip has no say whatsoever in admission or denial for admission by the hotel. Unmarried or unrelated couples may not be allowed to check-in by some hotels as per their policies. Similarly, accommodation may be denied to guests posing as a couple if suitable proof of identification is not presented at the time check-in. Some hotels may also not allow local residents to check-in as guests.Cmytrip will not be responsible for any check-in denied by the hotel due to the aforesaid reasons or any other reason not under the control of Cmytrip. No refund would be applicable in case the hotel denies check-in under such circumstances.

ADDITIONAL CHARGES BY THE HOTEL:
The booking amount paid by the User is only for stay at the hotel. Some bookings may include breakfast and/ or meals as confirmed at the time of booking. Any other services utilized by the User at the hotel, including laundry, room service, internet, telephone, extra food, drinks, beverages etc. shall be paid by the User directly to the hotel.

Hotels may charge a mandatory meal surcharge on festive periods like Christmas, New Year's Eve or other festivals as decided by the hotel. All additional charges (including mandatory meal surcharges) need to be cleared directly at the hotel. Cmytrip will have no control over waiving the same.

PAYMENT FOR BOOKINGS:
Booking of a hotel can either be “Prepaid”, or “Pay at hotel” as per the options made available by a hotel on the Website of Cmytrip.com

In Prepaid:
The total booking amount is paid by the User at the time of booking itself. Such total booking amount includes the hotel reservation rate, taxes, service fees as may be charged on behalf of the actual service provider, and any additional booking fee or convenience fee charged by cmytrip.

In Pay at hotel:
The concerned hotel will collect the entire payment against the booking at the time of check-in. In case of international bookings, the payment will be charged in local currency or in any other currency, as decided by the hotel.

For security purposes:
The User must provide cmytrip with correct credit or debit card details. Cmytrip may cancel the booking at its sole discretion in case such bank or credit card details as provided by the User are found incorrect.

Exchange rate/ card charges:
Some banks and card issuing companies charge their account holders a transaction fee when the card issuer and the merchant location (as defined by the card brand, e.g. Visa, MasterCard, American Express) are in different countries. If a User has any questions about the fees or any exchange rate applied, they may contact their bank or the card issuing company through which payment was made.

Security deposit:
Some accommodation suppliers may require to present a credit card or cash deposit upon check-in to cover additional expenses that may be incurred during their stay. Such deposit is unrelated to any payment received by cmytrip and solely at the behest of the Hotel.

3.BUS:
Cmytrip only provides a technology platform that connects intending travelers with bus operators. It doesn’t operate any bus or offer the service of transportation to the User. Cmytrip also doesn’t act as an agent of any bus operator in the process of providing the above-mentioned technology platform services.

The bus ticket booking voucher which Cmytrip issues to a User is solely based on the information provided or updated by the bus operator regarding the seat availability.

The amenities, services, routes, fares, schedule, bus type, seat availability and any other details pertaining to the bus service are provided by the respective bus operator and Cmytrip has no control over such information provided by the bus operator.

LIMITATION OF LIABILITY:
In its role as a technology platform to facilitate transactions between the bus operators and the Users, cmytrip shall not be responsible for the operations of the bus operator including, but not limited to the following:

• Timely departure or arrival of the bus.
• The conduct of bus operator's employees, representatives or agents.
• The condition of the bus, seats etc. not being up to the customer's expectation or as per the description provided by the bus operator.
• Cancellation of the trip due to any reasons.
• Loss or damage of the baggage of the customer.
• The bus operator changing a customer's seat for any reason whatsoever.
• Bus operator informing a wrong boarding point for the issuance of the booking confirmation voucher, or changing such boarding point eventually with or without any notification to Cmytrip or the User.
• Bus operator using a separate pick-up vehicle to transport the User from the designated boarding point to the actual place of departure of the bus.

RESPONSIBILITIES OF THE USERS:
Users are advised to call the bus operator to find out the exact boarding point, or any information which they may need for the purpose of boarding or travel in that trip.

At the time of boarding the bus, Users shall furnish a copy of the ticket, and any valid identity proof like aadhar card, passport, PAN card or voter identification card or any other identity proof issued by a government authority.

Users are required to reach the boarding place atleast 30 minutes before the scheduled departure time.

All tickets issued shall be non-transferable.

User needs to compulsorily obtain a bus ticket at the regular fare in case a child above the age of 5 years is accompanied by them, unless otherwise a particular bus operator specifies otherwise in their terms and conditions.

4.Tour packages:
Hikes in Tariffs & Taxes:

We inform you on prior basis that after the finalization of the tour package rates, for any hike in entrance fees, fuel cost, guide charges, and other services, you can be charged as extra.

If government revises some taxes on travel services, clients are liable to pay that extra amount.

SUPPLIERS ALTERATIONS ON TOUR ITINERARIES In the event of material alterations by a supplier to a proposed tour booked by you, you may be given the option of cancelling the tour without penalty, but this is not guaranteed. The right to cancel is subject to the terms and conditions of the supplier. Your acceptance of any tickets, coupons, exchange orders, vouchers and receipts will be deemed acceptance of the above conditions and of any alterations made to your tour  

5.ACTIVITIES AND OTHER SERVICES
DEFINITIONS:

‘Activity’ includes day tours & sightseeing, transfers, spa & wellness, adventure sports, cruise, theme/ amusement parks, buffets & dining or any other service/product booked on the Website.

The provider of the Activity will be referred as ‘Activity Provider’, who shall be solely responsible for provision of the products/ services booked by the User.

ROLE AND LIMITATION OF LIABILITY:
Cmytrip role is limited to facilitating the procurement of an Activity service by the User from the Activity Provider. The transaction or the service fulfilment relation is always between the User and the Activity Provider.

Cmytrip shall not provide pick up and drop facility for any Activity unless otherwise explicitly mentioned in the confirmation of the reservation.

Cmytrip shall not be liable or responsible for Any damage or loss, injury, accident, death, breakdown, irregularity, delay/change in schedule, cancellation without cause, inaccurate information, deficiency of service/product, or cancellation due to conditions not under the control of Activity Provider.

The health, safety and well-being of the User in the course of availing the Activity or thereafter.

Any incidental or ancillary services which is directly purchased by the User from the Activity Provider.

Any incorrect information provided by the Activity Provider. The maximum liability of Cmytrip will be limited to refund of booking amount which was received by Cmytrip for reservation of the Activity.

CANCELLATION CONDITIONS:
Reservations will be subject to cancellation and refund policies of the Activity Provider which may vary from time to time. Cmytrip may charge applicable taxes or service charge, convenience fees etc. wherever applicable. For more details kindly refer to our cancellation and refund policy.

Terms and Conditions of Use:

Cmytrip international Pvt Ltd may add, change, discontinue, remove or suspend any other Content posted on this Site, including features and specifications of products described or depicted on the Site, temporarily or permanently, at any time, without notice and without liability.

Cmytrip international Pvt Ltd reserves the right to undertake all necessary steps to ensure that the security, safety and integrity of Cmytrip’s systems as well as its clients' interests are and remain, well-protected.

Towards this end, Cmytrip may take various steps to verify and confirm the authenticity, enforceability and validity of orders placed by you.

If Cmytrip International Pvt Ltd, in its sole and exclusive discretion, concludes that the said orders arenot or do not reasonably appear to be, authentic, enforceable or valid, then Cmytrip may cancel the said orders at any time up to 3 hours before the scheduled time of departure of the relevant flight or 3 hours before the expected date of visit to any property booked through Cmytrip international pvt ltd.

Terms and Conditions of Booking:

Rates and Price Variations:
We reserve the right to vary prices and rates in the event of changes in exchange rates or price rises made by wholesalers or other suppliers. If the cost of any service increases due to exchange rate fluctuations, price increases, tax changes or any other reason, you are required to pay the increase when notified by us or you may cancel the booking which may result in cancellation fees. We are not liable in any way if any increase occurs. Rates quoted are appropriate to the particular product at the time of quoting and these rates may change prior to the travel date. All prices are subject to availability and can be withdrawn or varied without notice.

Final Payment:
Final payment must be paid immediately when requested prior to travel date. No vouchers will be issued until final payment is received. Final payment conditions for certain air, Hotel and tour products may vary, these are shown on the individual pages. We will advise you in writing of these conditions at the time of booking. Please note the final payment may vary from the original booking price or quote if the product is subject to exchange rate fluctuations or price rises by wholesalers or other suppliers.

Card Fees:
Please note that a card fee will be applied automatically to credit card payment amounts:
This fee covers a range of costs associated with processing bookings paid for by credit card including the merchant fees of the various credit card companies, payment processing costs, administration costs, the cost of maintaining IT systems used for payment security to minimise credit card fraud, credit card chargebacks and associated fees.

ADM POLICY:
Any ADM arising due to the below mentioned reasons will have to be borne by the Travel Partner

• GDS Misuse
• Fictitious Names or Fake Name Like Test Names / Wrong Names
• Duplicate Bookings • Churning for same segment / Flight / Date
• Hold Bookings must be released or issued before Time Limit to avoid Agent Debit Memo (ADM).
• In Case the Booking is aborted at the time of Hold or Booking - Please don’t issue tickets multiple times, Please contact our call centre for further action - ADM's will be borne by the agent if not guided by this policy

Terms and Conditions of Online Payments:
Payments/Top Ups/ Paid for Order:
Please note that any transaction done through any Online Payment by our registered agents or walking customer comes to an agent. In case of Walk-in customer swiping the card for a booking or Wallet update, Card holder is fully responsible for it and if any dispute/Chargeback raised will be taken care by the Cmytrip registered agent.

Wallet Update:
If any transaction through any online payment mode and payment gets success however booking fails than that transaction amount (Excluding Payment gateway charges) will be credited to Cmytrip Agent wallet. In-case of processing refund, based on standing instruction from the Cmytrip Agent it will be refunded through respective payment mode used while transaction.

Payment Gateway Fees:
Please note that any payment Gateway fee will be applied automatically to the online payment option. Payment gateway charges will be Non-refundable in any circumstances. Payment Processing Terms & Conditions:
By providing your credit card details and accepting our Terms & Conditions, you authorise Cmytrip to arrange for funds to be debited from your nominated credit card, in accordance with the terms & conditions of the Direct Debit Request Service Agreement as amended from time to time. Your bank or credit card provider may apply currency conversion fees. Credit Cards are required to secure bookings if you are travelling within 7 days.

Credit Card Chargeback Fees:
Any fees charged to Cmytrip by our credit card payment provider arising from a chargeback or a disputed charge on the cardholder's credit card will be charged to the cardholder or registered agency. His fee is non-refundable.

Outstanding:
If any outstanding is due, its unpaid after several reminders, Cmytrip has rights to recover by future flown tickets.

Payment Options:
Cmytrip offers a secure server for your credit card payments.

NOTE:
Money credited to the Cmytrip wallet will not be credited back to individual/agents bank account.

Promotion:
Your personal information will be used by Cmytrip to contact you regarding transactions, reservations, promotions, offers, surveys, new goods or services, etc. via emails, texts, calls, IVR, instant messaging services like WhatsApp, etc
